Non-Public School Placements

For students with specific learning disabilities, who have made little progress over time

For students who are emotionally disturbed and need a specialized program

School district, SELPA and County Mental Health required to reimburse parent for cost of placement ordered by Juvenile Court

Behavioral Programs for Autistic Children

Early intervention services for autistic children from private providers

Trained aides to work with students in the classroom

Ph.D. level supervision of behavioral programs

Compensatory Education

Remedial educational instruction necessitated by district's failure to provide "free appropriate public education"

Intensive Reading Instruction

For decoding problems, using phonology and phonics as mandated by California Reading Initiative

For comprehension problems, using guided comprehension strategies

Independent Assessments

Reimbursement and direct pay by school districts where the parent disagrees with a school district assessment for psycho-educational assessments by independent psychologists; speech and language assessments; assistive technology assessments; occupational therapy assessments, etc. 

Behavioral Intervention Plans

School districts required to conduct functional analysis assessment in order to develop appropriate behavior intervention plan

Proved at due process hearing that school district's failure to develop and implement behavioral intervention plan unnecessarily resulted in student's residential placement by Juvenile Court

School district required to adopt behavior plan providing that school administrators must confer with student's attorney prior to any further suspensions

Suspension/Expulsion

School district's failure to determine special education eligibility and/or perform manifestation determination resulted in reinstatement of students.

Stay Put

Obtaining stay put orders from both the administrative hearing office and federal district court

Least Restrictive Environment

Placement changed from SDC class to general education (with and without classroom aides)

Eligibility Determination

School district that denied eligibility, required to reassess student and make student eligible. 

School districts held to procedural time-lines for completing assessments and determining eligibility

School district required to assess student in all areas of suspected disability

Occupational/Speech and Language Therapy

Reimbursement and direct pay by school districts for occupational as well as speech and language therapy by independent occupational therapists

School districts required to increase the level of services

Damages

School district and individual school district employees required to pay damages for knowing and intentional violations of the IDEA
